Terms & Conditions/Waiver & Release of Liability READ BEFORE AGREEING By checking the box below, I/we (Parent/Guardian of Participant and/or Participant) agree to the following terms and conditions of participating in the Programs provided by Greater Shediac Sailing School (GSSS). 1. Medical Condition & Authorization The Participant is physically able to participate in the programs offered by GSSS and I know of no medical or other condition that would limit his/her participation. Swimming Ability Declaration: I confirm that the Participant can swim unassisted for at least 25 meters and tread water for 2 minutes. I understand GSSS strictly requires lifejackets to be worn at all times on and near the water, even for competent swimmers. GSSS will not conduct any physical examinations and will rely solely on information I provide separately. I authorize GSSS directors, coaches, staff, and associates to obtain emergency medical or surgical treatment and hospitalization for the Participant if, in their judgment, it is necessary. 2. Borrowed Equipment/Lifejacket Agreement Participant may be provided with GSSS equipment, including lifejackets, sails, boats, or other gear for use during Programs. I agree to inspect all borrowed items before use and report any defects immediately. Participant will use equipment responsibly and only for its intended purpose. I/we are liable for any loss, damage, or theft of borrowed equipment due to negligence or misuse, and agree to reimburse GSSS for repair or replacement costs at full value. 3. Financial Responsibility & Insurance I will be financially responsible for any medical attention needed during the program or resulting from injuries sustained. I represent that I have adequate health and medical insurance covering Participant for all Program activities. GSSS insurance shall not cover such expenses. Lost or Stolen Personal Property: GSSS is not responsible for any lost, stolen, or damaged personal items (e.g., clothing, gear, electronics) brought by Participant. Participants bring items at their own risk; secure valuables at home. 4. Compliance with Program Participation Rules Participant agrees to comply with all GSSS rules, policies, and requirements. GSSS may remove Participant at its sole discretion for safety concerns, non-compliance, or disruptive behavior. I/we release GSSS from all claims arising from such removal or Participant's failure to follow rules. 5. Assumption of Risk of Program Activities I understand and acknowledge that participation in the Programs involves inherent and foreseeable risks, including but not limited to injury, permanent disability, or death, arising from travel, land and water activities, weather conditions, equipment use, and the actions or omissions of others. I further understand that these risks exist even when safety rules are followed, equipment (including lifejackets) is used properly, and GSSS exercises reasonable care. I/we voluntarily and knowingly assume all such risks, both known and unknown, associated with the Participant’s involvement in the Programs. 6. Release & Hold Harmless To the fullest extent permitted by law, I/we hereby release, waive, and forever discharge GSSS and its coaches, instructors, staff, management, directors, sponsors, volunteers, agents, and the owners/lessors of any premises used for the Programs (the “Releasees”) from any and all claims, demands, actions, causes of action, damages, or losses of any kind arising out of or related to the Participant’s participation in the Programs, whether arising from the negligence of the Releasees or otherwise. I/we agree that this release is intended to be as broad and inclusive as permitted by applicable law. 7. Indemnity I/we agree to indemnify and hold harmless the Releasees from and against any and all claims, demands, actions, damages, losses, liabilities, and expenses (including legal fees and costs) arising out of or related to the Participant’s participation in the Programs, including but not limited to claims brought by or on behalf of the Participant or any third party, whether arising from the negligence of the Releasees or otherwise, to the fullest extent permitted by law. 8. Payment Registration must be paid in full at time of registration. 9. Cancellation Policy Full Program credit (minus 3.5% administration fee) if cancelled 14+ days before start. GSSS may cancel Programs without notice, issuing full refund (minus 3.5% fee); not liable for travel/incidental costs. 10. Publicity I grant GSSS, its affiliates, sponsors, and representatives an irrevocable, perpetual, worldwide, royalty‑free right to use, reproduce, distribute, display, and publish photos, videos, audio recordings, or other likenesses of the Participant taken during the Programs for advertising, marketing, social media (including but not limited to Instagram, Facebook, TikTok), websites, newsletters, brochures, and any other promotional or commercial purposes. This includes the right to edit, modify, or combine such media with other content. I waive any right to inspect or approve the final materials or to receive compensation. If I do not consent, I will notify GSSS in writing at [email protected] before the Program start; otherwise, this consent is deemed given. 11. Student Behaviour GSSS may cancel participation and refund unused fees (at discretion) for disruptive behavior, including unsafe social media use, filming, or privacy/safety infringements on GSSS premises (Pointe du Chêne Harbour Authority, Yacht Club, events). 12. Limitation of Liability To the fullest extent permitted by law, GSSS's total aggregate liability—whether arising in contract, tort (including negligence), strict liability, or otherwise—arising out of or related to these Terms, the Programs, or any services provided, shall not exceed 100% of the total fees paid by me to GSSS for the Participant. This cap applies to all claims, damages, losses, costs, or expenses (direct, indirect, consequential, or otherwise), except for liabilities that cannot be limited by law (e.g., gross negligence or willful misconduct, if applicable). The parties acknowledge this as a material term of the agreement. 13. Severability In the event that any provision of these Terms and Conditions, or the application thereof to any person or circumstance, is determined to be invalid, illegal, or unenforceable, such provision shall be severed from these Terms and Conditions, and the remainder shall fully continue in full force and effect permitted by law. 14. Governing Law These Terms shall be governed by the laws of New Brunswick and the federal laws of Canada applicable therein. Any disputes shall be resolved exclusively in the courts of New Brunswick, with the prevailing party entitled to reasonable attorney fees and costs. 15. Entire Agreement These Terms and Conditions constitute the entire agreement between the parties regarding the Programs and supersede all prior understandings, representations, or agreements, whether oral or written. No amendments or waivers shall be effective unless in writing and signed by both parties.
